Student Rights

Overview
As a Rockhurst student charged with a violation of the Student Code of Conduct, you are provided certain rights and processes in the University's Disciplinary system. The process began when a member of the University community alleged that you violated the rules and regulations of the Student Code of Conduct. Although additional investigation may be done, charges have been initiated and you will receive a letter outlining the process and the specifics of the charges.

A Hearing will be scheduled between you and a Hearing Examiner. At the Hearing, the Hearing Examiner will explain the process and the allegations against you. You will have the opportunity to discuss and respond to the allegations.

The Assistant Dean of Students or designate will determine whether it is more likely than not that you are responsible for the alleged Student Code of Conduct violations, and if so, will impose appropriate sanctions.

Throughout the Disciplinary process, you may have an advisor present. Your advisor's role is to counsel you in a manner that does not disrupt the proceedings. Written or whispered words are appropriate. Your advisor may not represent you, or address other parties, witnesses or the Hearing Board.

  • my right to review relevant information and documents included in my disciplinary file,
  • the sanctions possible for my alleged behavior,
  • my right to have an advisor present throughout the process,
  • my choice whether to appear at the hearing or answer questions and the fact that the hearing may proceed in my absence or despite my silence and a decision be made based upon the available information, and the appeal process.

Off-Campus Misconduct Policy
Given that the University's interest in student welfare is not bound by campus property lines, its commitment to neighborhood relations is high, and a positive reputation within the broader Kansas City community is essential for its continued well-being, the University reserves the right to act on violations that occur off- campus or at University-sponsored or sanctioned events and activities regardless of location.

Communication
All notices under the Code of Conduct will be delivered in person or to the room for those living on campus at least 7 days before the scheduled hearing date, or sent by US mail to the person's last known address.

 

Records and Notification
Student records will be kept for seven years or indefinitely if a student as been suspended or expelled from the University.
